Data processing purposes:

1. Supplier data
The following (personal) data will be stored, processed or processed by us for the purpose of fulfilling the contract or implementing pre-contractual measures, supplier relationships, payment processing, document management as well as accounting and logistics: Name, address, phone number, assigned contacts, e-mail address, account information, VAT ID number, employer number. In principle data of the supplier will not be transmitted to third parties without his consent, with the exception of necessary transmissions to service providers and subcontractors or associated companies, customers as well as authorities and courts in case of need. The legal basis for this data processing is the implementation of pre-contractual measures or the fulfillment of the contract as well as the fulfillment of a legal obligation (Art. 6 para. 1 lit b and c EU GDPR).

2. Customer data:
The following (personal) data will be stored, processed or processed by us for the purpose of fulfilling the contract or implementing pre-contractual measures, customer service and marketing, document management as well as accounting and logistics: Name, address, phone number, assigned contacts, e-mail address. In principle, customer data will not be transferred to third parties without the customer’s consent, with the exception of necessary transfers to service providers and subcontractors or affiliated companies as well as to authorities and courts in the event and in individual cases due to legitimate interests in banks and creditor protection institutions for the purpose of credit assessment. The legal basis for this data processing is the fulfillment of the contract, the fulfillment of a legal obligation as well as the legitimate interest of F-Energies GmbH (Art. 6 para. 1 lit b, c and f EU GDPR).

3. Applicant data:
The following (personal) data will be processed or stored by us for the purpose of organizing, managing and documenting applicants, keeping records, including automatically generated and archived text documents in these matters: Name, address, telephone number, date of birth, e-mail address, certificates, qualifications. The legal basis for this data processing is the implied consent or the legitimate interest of F-Energies GmbH (Art 6 para 1 lit a and f EU GDPR).

Time limits foreseen for the deletion of data: Due to statutory retention periods, the storage period is at least 7 years (§ 212 UGB as well as § 132 BAO), and longer depending on warranty periods, in any case until the termination of the business relationship or due to limitation periods under damages law in individual cases up to 30 years (§ 1489 ABGB). The applicant data will be stored at least for a 12-month period (§ 15 GlBG) or as long as the data are needed for the purpose of data processing.

Note on rights of affected parties:

Due to the EU data protection basic regulation as well as the Austrian data protection law (DSG) we are obliged to inform you about the rights granted to you concerning personal data, namely about the right of information, the right to correction, the right to deletion, the right to restriction of the processing, the right to data transfer, the right to objection, besides about the existence of a right of complaint with the Austrian data protection authority. You can therefore request information from us about your data stored by us and also request us to correct, delete or revoke your consent (in the case of consent given). In such a case please contact us (see contact details of person responsible). For the sake of clarity, it should be pointed out that the above rights of data subjects under the EU GDPR only apply to natural persons, whereas legal persons cannot exercise these rights. However, under the Austrian Data Protection Act, legal persons have the right to obtain information on the processing of personal data concerning them, the right to rectify inaccurate data and the right to delete data processed improperly.

The provision and processing of the above personal data is necessary for the fulfillment of the contract or due to legal obligations and legitimate interests on our part. Failure to make such a provision would frustrate the conclusion of the contract or would constitute a breach of legal obligations and give rise to administrative penalties.
